1 About MetalMorph and these terms
These terms govern purchases from metalmorph.store, operated by MetalMorph, a business registered in the United States. Our business identification and contact details appear in the Legal Notice and Contact Information sections of this website. By placing an order after being given the opportunity to review these terms, you agree to them. You must have legal capacity to enter the contract and authority to act for any business making the purchase.
These terms apply to our own online store. Purchases made through Etsy or another marketplace are also subject to that platform’s applicable rules and procedures; marketplace protection programmes do not automatically apply to purchases from this website.
2 What you are buying
You are purchasing a licence to use digital design files, not a finished physical product or ownership of the underlying intellectual property. No metal parts, materials, tools, printed plans or assembled products will be shipped. Photos and renderings illustrate the intended fabricated object or its use; only the digital items expressly listed are included.
The product description specifies the included formats, dimensions, material requirements and available instructions. Some products include DXF files only; PDFs, assembly guidance, ebooks and other extras are included only where stated. Please review the listing and ask us about compatibility or requirements before ordering.
3 Orders and payment
Prices and the checkout currency are shown on the website. The total payable, including applicable taxes, is disclosed before you confirm the order. Payments are processed through the payment options offered at checkout, including PayPal and Shopify Payments where available. Files are released after payment is successfully confirmed.
Provide an accurate email address and billing information. We may pause an order for a genuine payment or security issue and will contact you where appropriate. If we cannot fulfil a paid order, we will refund the amount paid. We will not increase the price of an accepted order without your agreement; any correction must respect applicable consumer law.
4 Delivery and access
Digital files are delivered through Easy Digital Products. Once payment is confirmed, a download link is sent to your checkout email address and a download button is available on the post-purchase page. See our Shipping and Digital Delivery Policy for full details.
Downloads have no expiry date or numerical download limit. Please retain a backup of your files. If a link stops working, contact us for help restoring access. Unlimited downloads do not permit sharing a download link or distributing the files. Cancellation, a full refund or lawful termination of the licence may end access to the affected product.
5 Personal and commercial fabrication licence
Upon payment, MetalMorph grants the purchasing person or business a non-exclusive, non-transferable, perpetual licence to use the purchased files for personal projects and to manufacture and sell physical objects made from those designs. No per-unit royalty is charged under this licence. The licence remains subject to these terms and any lawful termination.
You may make working copies and modify the files for your own fabrication needs. You may share the necessary files with a cutting service, fabricator or workshop solely to carry out manufacturing on your behalf. Tell the workshop that the files are confidential licensed materials: it may not reuse them for other customers, sell them, distribute them, or retain them for unrelated future work. Require it to delete working copies when the authorised work is complete, except where retention is legally required.
6 Restrictions and intellectual property
You may not sell, give away, sublicense, publish, upload or otherwise redistribute the digital files, including modified versions or conversions to other formats. You may not place them in shared libraries, public repositories, digital bundles or competing downloadable products, or share your purchase link with others. The limited workshop permission above is the only third-party file-sharing permission granted by these terms.
You may sell the physical objects you manufacture, but you may not claim authorship or ownership of MetalMorph’s original digital designs or remove ownership notices from the files. MetalMorph and its licensors retain their applicable intellectual property rights. This licence does not authorise use of third-party trademarks or other protected material beyond any rights expressly granted.
7 Fabrication and safe use
Fabrication requires suitable equipment, materials and skills. Before cutting or manufacturing, check scale, units, material thickness, clearances, tolerances, joints and fit. Adapt cutting settings and allowances to your process and make test pieces where appropriate. Changes to dimensions, materials or construction can affect strength and performance.
Unless expressly stated in the listing, the files do not include a site-specific engineering assessment, certification, load rating or regulatory approval. You are responsible for assessing the suitability and safety of objects you manufacture, including applicable requirements for structural loads, wall fixings, heat, ventilation, fire safety and food contact. Seek qualified professional assessment where needed, particularly for load-bearing or safety-critical uses.
MetalMorph is responsible for supplying digital content that meets its description and applicable legal requirements. These fabrication responsibilities do not exclude our liability for a defective design or any other liability that cannot lawfully be excluded.
8 Support and refunds
For access problems, file questions or suspected errors, email metalmorph.design@gmail.com. Support does not include custom design work, file conversion, engineering certification or training unless expressly included in your purchase or separately agreed. Any separately commissioned work requires its own agreed scope, price and delivery terms.
Our Refund and Returns Policy forms part of these terms. Undownloaded products can be cancelled under that policy. Downloaded products are not eligible for change-of-mind refunds, subject to mandatory consumer rights. Defects and discrepancies are handled through support and the remedies required by applicable law.
9 Responsibility and mandatory protections
We do not promise a particular manufacturing profit, business result or compatibility with equipment or software not identified as supported in the listing. To the extent permitted by law, we are not responsible for losses caused solely by your unauthorised modifications, unsuitable materials, unsafe fabrication, incorrect installation or misuse, rather than by a breach or defect attributable to us.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your statutory rights, including applicable rights to compensation and remedies, remain unaffected.
10 Privacy and disputes
Our separately published Privacy Policy explains how personal information is handled. Please contact us first if you have a concern so we can try to resolve it. This request does not prevent you from contacting a regulator, payment provider or competent court, or exercising any legal right. These terms do not impose mandatory arbitration, waive class-action rights or remove the protection of mandatory laws or courts available to consumers.
11 Changes and termination
We may update these terms for future orders. Changes will not retrospectively reduce rights granted for an existing purchase. For a material licence breach, we may suspend access or terminate the affected licence where permitted by law, with notice and an opportunity to remedy the breach where required. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
